Many clients suffer from anonymous online abuse. Whether this is a component of the revictimization of someone suffering public trauma or a person finds themselves the target of a private campaign of hate or harassment, not knowing who is behind the attacks can be terrifying. At Merrell Strategy, figuring out who is responsible for the abuse and understanding their motivation (ideologic zealotry, clout, financial gain, etc.) is the first step in making them stop, holding them accountable, and determining whether pursuing them legally is an option.
However, not every abuser hides behind the anonymity of the internet. Some seek to create fame and fortune for themselves by playing accuser or whistleblower, publicly. Understanding their motivations and background, especially when extortion or character/brand assassination is the goal, is key. Is there a pattern of behavior? Have they extorted money or used assignation techniques in the past against others? Are they falsifying information or using AI to manipulate the narrative? Do they have nefarious associates? Do they have assets that would make it worthwhile to pursue them civilly? Conducting a “deep dive” into the background of an adversary provides both us with the information needed to guide litigators and to best advise clients as to the best course of action.

Knowing the predilection of a particular judge and of the public from which a jury pool may be drawn can also help determine a litigation strategy.
